Deed to Our Roads
Who Owns What Around Here

When my family purchased this property in Beaver Run it was referenced by a plat recorded at the Clerk of Court office and the County Tax office. That plat shows the boundaries extending to the center of the road. I purchased my property in 1987. This document was filed in 1991. So, how can Jim Frith deed that portion of the road that my family owns to the "Beaver Run Land Owners Association?" Conversely, When he sells a lot since this deed was recorded, these lots all are shown extending to the center of the road. How can he sell a lot that includes property that is listed as being owned by the "Beaver Run Land Owners Association?"
We have consulted with several attorneys and all of them say that this deed is giving ownership of this "PROPERTY" to the Association. This is a question that we need to ask the Haralson County Tax assessors office who keeps recording these deed and plat changes. They need to explain how a survey ordered and filed by Jim Frith can change my property lines.
I'm going to speculate and say that this was supposed to be just for the "Rights of Way." One main point here is that these roads, or rights of way, belong to the lot owners and purchasers in Beaver Run, all of us, not just Jim and Bonnie Frith. All decisions concerning these roads are to be made exclusively by "Road Committees" elected by the lot owners on each of the roads. See the Corrective Declaration of Restriction #19.
